1. Acceptance of Terms

By purchasing, accessing, handling, or taking delivery of any product sold or distributed by NexXGEN Peptides LLC (“NexXGEN Peptides”), you agree to be bound by these Terms and Conditions of Sale and Use (“Terms”). These Terms supersede any conflicting terms in purchase orders, emails, invoices, or other customer documentation unless expressly agreed to in writing by an authorized representative of NexXGEN Peptides.

2. Intended Use of Products (Research Use Only)

All products sold by NexXGEN Peptides are Research Use Only (RUO) materials, intended solely for:

  • In-vitro laboratory research,

  • Scientific investigation,

  • Analytical testing,

  • Education, and

  • Non-clinical research and development.

Products are not intended for:

  • Human consumption, injection, inhalation, implantation, or any form of administration,

  • Veterinary or animal use,

  • Medical, diagnostic, therapeutic, or prophylactic purposes,

  • Performance, physique, bodybuilding, hormone, or enhancement purposes,

  • Clinical trials, compounding, pharmacy use, or any FDA-regulated application.

Products are not approved by the FDA or any other regulatory authority. No claims are made regarding safety, efficacy, or suitability for any use beyond laboratory research.

3. Qualified Purchasers Only

By purchasing, you affirm that you:

  1. Are 21 years of age or older;

  2. Possess the professional knowledge, laboratory environment, and safety controls required to handle research materials; and

  3. Will use the products solely for legal, non-clinical laboratory research.

NexXGEN Peptides may verify purchaser identity or research intent at its discretion.

4. Order Screening and Right to Refuse Service

NexXGEN Peptides maintains compliance review procedures to prevent misuse or diversion.

The company may hold, cancel, or refuse any order if:

  • Intended research purpose cannot be verified,

  • Purchaser references human or animal use,

  • Regulatory or safety concerns arise.

All such decisions are final and made at the sole discretion of NexXGEN Peptides.

5. Customer Responsibilities

The purchaser is solely responsible for ensuring:

  • Compliance with federal, state, and local regulations,

  • Safe handling, storage, and disposal of laboratory materials,

  • Proper training and facility authorization.

Misuse of products releases NexXGEN Peptides from all liability.

6. No Warranties

All products are sold “AS IS” and without any warranties, express or implied, including:

  • Merchantability,

  • Fitness for a particular purpose,

  • Non-infringement.

NexXGEN Peptides’ total liability shall not exceed the original purchase price of the product.

7. Indemnification

The purchaser agrees to indemnify and hold harmless NexXGEN Peptides, its owners, members, officers, employees, suppliers, and affiliates from any claims, losses, liabilities, damages, penalties, fines, or expenses arising from:

  • Misuse, mishandling, or unlawful use of products,

  • Violation of these Terms,

  • Any human or veterinary administration.

8. Returns and Refunds

Due to the nature of research materials, all sales are final.

If an item is damaged or incorrect upon arrival, NexXGEN Peptides will replace or credit the item at its discretion.

9. Prohibition on Resale

Products may not be resold, repackaged, relabeled, transferred, exported, or distributed without prior written approval from NexXGEN Peptides.

Unauthorized resale voids all warranties and may result in legal action.

10. Zero-Tolerance Misuse Policy

Suspected misuse, diversion, or human/animal application will result in:

  • Immediate account termination, and

  • Potential notification to regulatory authorities.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida.
Any dispute shall be resolved by binding arbitration through the American Arbitration Association (AAA).
Customer consents to jurisdiction in Florida.

12. FDA Compliance Statement

All products are labeled:

“For Laboratory Research Use Only. Not for Human or Animal Consumption or Use. Not a Drug. Not Medical or Diagnostic Material.”

Use contrary to this designation may violate federal law.

Acknowledgment

By purchasing or using products from NexXGEN Peptides, you confirm that you have read, understood, and agree to these Terms in full.
